    Environmental Enforcement Status Review

How do I get the current environmental enforcement status of a property or facility?

In order to obtain a letter of current enforcement status concerning a property or facility, DERM requires the submittal of

    • the folio number
    • address
    • legal description
    • names of any and all businesses currently operating at the subject site

For undeveloped land, the request must include a current aerial photograph indicating the boundaries of the requested site.

How long does it take to get the current environmental enforcement status of a property or facility?

Once DERM receives the application, a records search and an on-site inspection will be conducted.

A DERM conducted File and Records Search request will be processed by the individual Sections in DERM, which may have files or records pertaining to the requested sites or facilities.  Upon receipt of the responses from all the Sections, DERM will then send a letter providing you with the information obtained from the records search and the results of the on-site inspection. This process takes approximately three (3) to four (4) weeks.

You may then come in and review the file(s) that have been assembled.  Applicable fees may be charged pursuant to the provisions of Chapter 119 F.S.

How much are the fees for obtaining the current environmental enforcement status of a property or facility?

A check in the amount of $850.00 per folio, made payable to Miami-Dade County, for each and every site that information is requested.

The above-noted fee has been approved by the Miami-Dade County Commission and is incorporated into DERM’s Fee Schedule.

Can I do my own file and records search for the current environmental enforcement status of a property or facility?

An Individual-Conducted File and Records Search requires the individual to contact the appropriate Section of DERM and inquire as to whether or not records are on file regarding the subject site.

If records exist, you may then set up an appointment to come in and review the records. (See our organization table). Applicable fees may be charged pursuant to the provisions of Chapter 119 F.S.

For further information, please contact the DERM Pollution Regulation and Enforcement Section at 305-372-6946.  Please address your requests to Donna Gordon, Chief, Pollution Regulation and Enforcement Section, DERM, 701 NW 1st Court, Suite 700, Miami, Florida, 33136.
